UK GDPR Representative

UK GDPR ยท EU GDPR ยท Data Protection for Non-UK Companies

UK GDPR Representative for Companies Outside the UK

If your business is based in the UAE, the Gulf or elsewhere outside the UK, but sells to or monitors people in the UK, the UK GDPR may require you to appoint a representative in the UK. We assess whether the rule applies to you, prepare the documentation, and set up your UK representation as your point of contact with the ICO and with individuals.

The Legal Requirement

Article 27: A Rule Many Non-UK Companies Miss

Under Article 27 of the UK GDPR, a controller or processor that is not established in the UK, but offers goods or services to individuals in the UK or monitors their behaviour, must designate in writing a representative established in the UK. The EU GDPR contains a parallel rule for companies outside the EU that target individuals in EU member states.

The representative is the point of contact for the Information Commissioner’s Office (ICO) and for data subjects, and keeps a copy of your records of processing. Failing to appoint one where required is a breach in itself and can attract enforcement action and fines โ€” and it is often the first thing a regulator checks when a complaint arrives.

Common Questions

UK GDPR Representative โ€” FAQ

Usually yes if your company has no establishment in the UK but offers goods or services to people in the UK or monitors their behaviour, for example through online tracking. Occasional processing that is unlikely to create risk, and that does not involve large-scale sensitive data, may be exempt.
A representative is your contact point in the UK for the regulator and individuals. A Data Protection Officer is an internal compliance role required only for certain organisations. They are different obligations and one does not replace the other.
Since Brexit, the UK and EU rules are separate. A company outside both that targets individuals in the UK and in EU member states may need a representative in each. We assess both positions together.
Failure to appoint a required representative is a breach of the UK GDPR and can lead to enforcement action and fines. It also makes it harder to respond quickly when a complaint or regulator enquiry arrives.
No. Your company remains responsible for complying with data protection law. The representative is a point of contact and keeps a copy of your records of processing; it does not take over your legal obligations.
Yes. Our focus is companies based in the UAE and the wider region that sell into the UK and Europe, and we can align your UK and EU compliance with UAE federal and free-zone data protection rules.

Not on its own. What matters is whether you are targeting people in the UK. Signs of targeting include prices in pounds sterling, delivery to UK addresses, marketing aimed at UK audiences, a UK phone number or .co.uk domain, and references to UK customers. Tracking or profiling the behaviour of UK users online, for example through advertising cookies or analytics, can also bring you within scope.
Yes. Under Articles 13 and 14 of the UK GDPR, your privacy notice must give the identity and contact details of your representative. A missing representative in the privacy notice is one of the easiest gaps for customers and regulators to spot.
Failing to appoint a required representative falls within the lower tier of UK GDPR fines: up to ยฃ8.7 million or 2% of total worldwide annual turnover, whichever is higher. Under the EU GDPR the equivalent ceiling is โ‚ฌ10 million or 2% of worldwide turnover. In practice, regulators usually start with an enquiry, but the absence of a representative weakens your position from the first day.
It can. The rule concerns personal data of individuals in the UK, and the names, emails and phone numbers of contacts at your business customers are personal data. A B2B company that targets UK clients and processes their staff contact details may therefore be within scope.
Your company details and country of establishment, your website and apps, the countries you sell to, the categories of personal data you collect (for example customer, payment, marketing and tracking data), the service providers you use, and your current privacy notice. If you already have records of processing, we will review those too.
Yes, and it is usually more efficient. Many of the documents overlap: records of processing, privacy notices and transfer mechanisms can be prepared once and adapted to the UK GDPR, the EU GDPR, the UAE Federal Data Protection Law and free-zone rules such as those of the DIFC and ADGM.

The Role in Practice

What a UK Representative Does for You

๐Ÿ›๏ธ

Contact Point for the ICO

Receives enquiries from the Information Commissioner’s Office on your behalf and passes them to your team quickly, so that deadlines are not missed.

๐Ÿ‘ค

Contact Point for Individuals

Gives UK customers a local address to exercise their rights, such as access, correction and erasure requests, and forwards each request to you.

๐Ÿ“š

Keeps Your Records

Holds a copy of your records of processing activities under Article 30 and makes them available to the ICO on request.

๐Ÿค

Cooperation with the Regulator

Supports cooperation with the ICO under Article 31, including responding to information requests and coordinating with your management.

๐Ÿ”Ž

Visible in Your Privacy Notice

Is named, with contact details, in your privacy notice, showing customers and partners that you take UK data protection seriously.

๐Ÿ—‚๏ธ

Logging & Reporting

Keeps a log of all correspondence received and reports regularly to you, so you have a clear record if a dispute or investigation arises.

What a representative does not do: it does not take over your legal responsibility, decide how you use personal data, or replace a Data Protection Officer where one is required. Your company remains the controller and stays responsible for compliance.
