Cross-Border Data Transfers UAE – UK & EU GDPR

Cross-Border Data Transfers UAE · UK · EU

Cross-border data transfers between the UAE, the UK and the EU must rely on a lawful transfer mechanism. We map your international data transfers, choose the right tools, and prepare the documents, so your data flows can withstand a regulator’s questions.

The Legal Framework

Why Cross-Border Data Transfers from the UAE Need a Legal Basis

Under Chapter V of the UK GDPR and the EU GDPR, personal data may only be transferred to a country outside the UK or the EU if that country is recognised as providing adequate protection, or if appropriate safeguards are in place. The UAE is not currently on the UK or EU adequacy lists (see the ICO’s guidance on international transfers). In practice, many data flows involving UAE companies therefore need a transfer mechanism.

The same issue arises in the other direction. The UAE Personal Data Protection Law (PDPL, Federal Decree-Law No. 45 of 2021) and the free-zone regimes of the DIFC and ADGM each have their own rules on sending personal data abroad. A UAE company serving UK and EU customers often has to satisfy several transfer regimes at once.

International data transfers are not only about where your company is located. Cloud hosting, CRM and email platforms, payment providers, outsourced customer support and group companies in other countries can all involve transfers.

Common Questions

Cross-Border Data Transfers UAE — FAQ

Not at present. Transfers from the UK or the EU to the UAE therefore generally need appropriate safeguards, such as the IDTA, the UK Addendum or the EU SCCs, unless a narrow exception applies.
The IDTA is the UK’s own transfer agreement. The EU SCCs are the European Commission’s standard clauses. The UK Addendum lets you use the EU SCCs for UK transfers as well, which is often the most efficient choice for companies dealing with both markets.
In most cases where you rely on standard contracts, yes. The assessment considers whether the law and practice of the destination country could undermine the protection the contract provides.
Yes. The UAE PDPL and the DIFC and ADGM regimes each set conditions for sending personal data abroad. We design one approach that satisfies the UAE, UK and EU rules together.
Only in limited cases. Consent must be explicit and informed, and it is intended for occasional transfers, not for routine business data flows.
Not automatically. Major providers offer standard transfer terms, but you remain responsible for checking that they cover your actual data flows and that the right mechanism is in place.
