Iranian Law Expert Witness for Courts and Arbitral Tribunals

When a dispute turns on Iranian law, the tribunal needs an independent expert who can explain it clearly, accurately and in English. Dr. Ahmadreza Moini, a Grade One Iranian attorney, licensed arbitrator and university lecturer with a PhD in private law, provides expert reports and testimony on Iranian civil, commercial, contract and company law.

Why Foreign Law Needs an Expert

Iranian Law Must Be Proved, Not Assumed

In the courts of England and Wales and in most common-law jurisdictions, the content of foreign law is treated as a question of fact. A party relying on Iranian law must normally prove it through the evidence of a qualified expert. International arbitral tribunals take a similar approach and expect independent expert evidence on any national law that governs the contract or the parties’ capacity.

Iranian law combines a civil-law code structure with principles drawn from Islamic jurisprudence, and much of its practice is documented only in Persian. An expert who works with the primary sources, statutes and court practice in the original language can give the tribunal an accurate picture โ€” and withstand cross-examination.

  • 01

Foreign Law Is a Question of Fact

Courts and tribunals rely on expert evidence to establish what Iranian law says and how it is applied.

  • 02

    Primary Sources Are in Persian

Statutes, regulations, rulings and commentary must be read and translated accurately.

  • 03

    Independence Is Essential

An expert’s overriding duty is to the court or tribunal, not to the party paying the fee.

  • 04

    Clarity Wins Cases

The best expert evidence explains a foreign legal system in plain, well-structured English.
