Intellectual Property Law in Iran: Protecting Trademarks, Patents and Designs

← All Articles

Iran offers a registration-based system for the main categories of intellectual property. Foreign rights holders who register early enjoy strong protection; those who delay risk losing their brand to opportunistic local applicants.

Trademarks

Trademarks are registered with Iran’s Industrial Property General Office (IPGO). Iran operates a first-to-file system, so the first party to apply generally secures the rights — making early filing the single most important step for any brand entering the market. Iran is also party to international trademark arrangements, which can allow foreign owners to extend protection to Iran through international filings.

Patents and utility

Patents protect new inventions that are industrially applicable and involve an inventive step. Protection is territorial: a patent granted elsewhere does not automatically apply in Iran, so a separate national filing (or a filing routed through an applicable international procedure) is required.

Industrial designs and copyright

Industrial designs protect the ornamental appearance of a product and must be registered to be enforceable. Copyright protects literary, artistic and software works; while it arises without registration, recording the work strengthens the owner’s position in any dispute.

Enforcement

Iranian law provides civil and, in serious cases, criminal remedies against infringement, including injunctions, damages and seizure of infringing goods. Effective enforcement depends on holding a valid Iranian registration and on assembling clear evidence of infringement.

We handle searches, filings, oppositions and enforcement actions on behalf of international brand owners across all IP categories.
